
Cen Cal Baggers – Liability Waiver, Release & Assumption of Risk
IMPORTANT: PLEASE READ CAREFULLY. By participating in any Cen Cal Baggers (“CCB”) cornhole league, tournament, open play, social event, or related activity (collectively, the “Activities”), you agree to the terms of this Liability Waiver, Release, and Assumption of Risk (this “Agreement”).
1. Acknowledgment & Assumption of Risk
I understand that participation in cornhole and related recreational and social activities involves inherent risks, including but not limited to: slips, trips, falls, collisions with people or equipment, uneven surfaces, weather conditions, physical exertion, and potential exposure to food, beverage, or alcohol service environments. I voluntarily choose to participate in the Activities and assume all risks, whether known or unknown, foreseeable or unforeseeable, associated with my participation.
2. Release & Waiver of Liability
To the fullest extent permitted by California law, I hereby release, waive, discharge, and covenant not to sue Cen Cal Baggers, its owners, officers, directors, employees, contractors, volunteers, sponsors, partners, venue owners/operators, and agents (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, losses, or liabilities arising out of or related to my participation in the Activities, including claims for personal injury, illness, death, or property damage, except to the extent caused by the gross negligence or willful misconduct of the Released Parties.
3. California Civil Code §1542 Waiver
I understand that California Civil Code §1542 provides:
“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
I hereby expressly waive and relinquish any and all rights and benefits under Section 1542 and any similar law or principle.
4. Medical Treatment & Insurance
I certify that I am physically able to participate in the Activities and have no medical condition that would prevent safe participation. I understand that Cen Cal Baggers does not provide medical insurance for participants. I consent to receive emergency medical treatment if deemed necessary and agree to be financially responsible for any resulting medical expenses.
5. Alcohol, Venue Rules & Personal Conduct (If Applicable)
If alcohol is present or served at an event, I agree to act responsibly, comply with all applicable laws, and adhere to all venue rules and staff instructions. I acknowledge that alcohol consumption increases risk and agree that Cen Cal Baggers does not control alcohol service at third-party venues and is not responsible for the actions of bartenders, venue staff, or other patrons. I accept full responsibility for my conduct, intoxication, and any resulting injury or damage.
6. Photo, Video & Media Release
I grant Cen Cal Baggers the irrevocable right to photograph, record, and use my name, image, likeness, voice, and/or appearance in any media for promotional, marketing, or commercial purposes without compensation or prior approval.
7. Minors
Participants under 18 years of age may not participate unless a parent or legal guardian has reviewed and accepted this Agreement on their behalf. By allowing a minor to participate, the parent or guardian agrees to all terms herein and accepts full responsibility for the minor’s participation.
8. Website & Ongoing Events Acceptance
I understand and agree that participation in any Cen Cal Baggers event constitutes ongoing acceptance of this Agreement, which is made available on the Cen Cal Baggers website. I acknowledge that I am responsible for reviewing the current version prior to participation. This Agreement applies to all current and future events unless expressly revoked in writing by Cen Cal Baggers.
9. Venue & Third-Party Disclaimer
I understand that Cen Cal Baggers events may take place at public spaces, parks, bars, breweries, restaurants, or other third-party venues not owned or controlled by Cen Cal Baggers. I acknowledge that conditions at these venues (including flooring, lighting, furniture, weather exposure, crowd behavior, and security) are outside Cen Cal Baggers’ control. I hereby release the Released Parties from any claims arising out of or related to the condition of any venue or the acts or omissions of venue owners, operators, employees, contractors, or other patrons, to the fullest extent permitted by law.
10. Severability & Governing Law
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. This Agreement shall be governed by and interpreted in accordance with the laws of the State of California, and venue for any dispute shall lie exclusively in California courts.
10. Acknowledgment of Understanding
By participating in any Cen Cal Baggers event, I acknowledge that I have read this Agreement, understand its terms, and agree to be legally bound by it.
